Terms of Service
Last updated: 12 September 2026
These Terms of Service (“Terms”) govern access to and use of the website at kiwari.dev and the Kiwari product (together, the “Services”), operated by the operator of kiwari.dev (“Kiwari,” “we,” “us,” or “our”).
1. Acceptance
By accessing or using the Services, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Services.
2. The Services
Kiwari is an AI-assisted development tool that helps users build experiences in Roblox Studio from natural-language descriptions and related instructions. The Services are under active development. Features, availability, limits, and functionality may change. Parts of the Services may be suspended or discontinued where reasonably necessary.
3. Eligibility
You must be able to form a binding contract under applicable law to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts
Certain features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify support@kiwari.dev promptly if you suspect unauthorized access.
5. Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. Without limitation, you may not:
- violate any applicable law or third-party rights;
- create, distribute, or attempt to create malicious, harmful, or deceptive content or code;
- violate Roblox’s terms, policies, or community standards when using the Services with Roblox;
- attempt to disrupt, probe, reverse engineer (except to the limited extent permitted by law), or gain unauthorized access to the Services or related systems;
- abuse, overburden, or interfere with the Services, including by circumventing usage limits or security controls; or
- misrepresent the Services’ output as human-authored where disclosure is required by law.
6. Input and Output
You retain rights in content you submit to the Services (“Input”), to the extent you have those rights. Subject to applicable law and your plan, you may use content generated by the Services in response to your Input (“Output”) for your own projects, including commercial projects.
You grant us a limited license to host, process, transmit, and display Input and Output as needed to provide and maintain the Services. You are responsible for Input you provide and for how you use Output. AI-generated Output may be incorrect, incomplete, or unsuitable and should be reviewed before reliance.
7. Intellectual property
The Services, including software, branding, and related materials we provide, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
8. Payment and subscriptions
Paid plans may be offered through a third-party merchant of record or payment provider. Pricing is shown on the Pricing page and in the product. Fees are charged only with your agreement. Billing, taxes, refunds, and related checkout terms may be governed by that provider’s terms in addition to these Terms. Unused allowances or credits may expire according to the plan terms shown at purchase or in the product.
9. Third-party services
The Services may interoperate with third-party platforms and services, including Roblox. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services we do not control.
10. Suspension and termination
Access to the Services may be suspended or terminated if you breach these Terms, if required by law, or if needed to protect the Services, us, or others. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination, including ownership, disclaimers, and limitations of liability.
11. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any Output will be accurate, complete, or fit for your use case.
12. Limitation of liability
To the fullest extent permitted by law, Kiwari and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or business, arising out of or related to your use of the Services, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services will not exceed the amounts you paid to us for the Services in the twelve (12) months before the claim, or one hundred US dollars (US $100) if you have not paid any amounts.
13. Indemnity
You agree to defend, indemnify, and hold harmless Kiwari and its operators from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your Input or Output, or your violation of these Terms or applicable law.
14. Changes
These Terms may be updated from time to time. If material changes are made, reasonable steps will be taken to notify you, such as posting an updated version on this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
15. General
These Terms are the entire agreement between you and us regarding the Services and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
